Ottawa is asking the Supreme Court of if the government has the authority to create a national securities regulator.

Justice Minister Rob Nicholson says the government will seek the opinion of the court on the constitutionality of the proposed Canadian securities legislation.

The draft legislation is expected to be ready by next spring.

The government says it is also continuing to work with its provincial and territorial partners to develop the legislation that would allow voluntary participation.
